Terms and Conditions

1. Scope

These Terms and Conditions apply to all business relationships between the provider Parres & Rodriguez Design, located at Aschaffenburger Str. 110 A  64832 Babenhausen, and the customer. Our online shop is exclusively directed at consumers.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity. An entrepreneur is a natural or legal person or a legal partnership with legal personality that acts in the course of its commercial or self-employed professional activity when concluding a legal transaction.

2. Conclusion of Contract

The purchase contract is concluded with Patres & Rodriguez Design.

The presentation of products in the online shop does not constitute a legally binding offer but an unbinding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries before submitting your binding order at any time by using the correction aids provided and explained in the order process. By clicking the order button, you place a binding offer for the goods contained in the shopping cart. The confirmation of the receipt of your order is sent by email immediately after sending the order.

We accept your offer within two days:

  • By providing a declaration of acceptance in a separate email, or
  • By delivering the goods, or
  • If necessary, by carrying out the payment transaction through our service provider or the selected payment service provider. The timing of the payment transaction depends on the selected payment method (see “Payment”).

The relevant alternative for you depends on which of the enumerated events occurs first.

3. Contract Language, Storage of Contract Text

The language(s) available for the conclusion of the contract: German, English, Spanish.

We store the contract text and send you the order data and our Terms and Conditions in text form. You can view the contract text in our customer login.

4. Delivery Conditions

In addition to the indicated product prices, shipping costs and customs duties may apply. You can find more detailed information about any applicable shipping costs or customs duties in the offers or in the shipping information.

5. Payment

In our online shop, the following payment methods are generally available to you:

Direct bank transfer

Transfer directly to our bank account. Please use the order number as the payment reference. Your order will be shipped only after the payment has been received in our account.

Credit card

In the ordering process, you provide your credit card details. Your card will be charged immediately after placing the order.

PayPal

To pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg (“PayPal”), you must be registered with PayPal, authenticate yourself with your login details and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after placing the order. You will receive further information during the order process.

Apple Pay

To pay the invoice amount via the payment service provider Apple Inc., One Apple Park Way, Cupertino, CA 95014, USA (“Apple”), you must use the “Safari” browser, be registered with Apple, have activated the Apple Pay function, authenticate yourself with your login details, and confirm the payment instruction. The payment transaction is carried out immediately after placing the order. You will receive further information during the order process.

6. Transport Damages

If goods are delivered with obvious transport damages, please report such faults to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or contact has no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or the transport insurance.

7. Warranty and Guarantees

8. Liability

We always assume unlimited liability for claims arising from damages caused by us or our agents:

  • In case of injury to life, body, or health,
  • In case of intentional or grossly negligent breach of duty,
  • In case of warranty promises, as agreed, or
  • To the extent that the scope of the Product Liability Act is opened.

In case of violation of essential contractual obligations, the fulfillment of which is necessary for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations), caused by slight negligence on our part, our legal representatives or agents, liability is limited in terms of the amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be anticipated. In all other respects, claims for damages are excluded.

9. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are neither obligated nor willing to participate in a dispute resolution procedure before a consumer arbitration board.

10. Protection of Minors

If your order includes goods whose sale is subject to age restrictions, we ensure, through the use of a reliable procedure involving personal identity and age verification, that the purchaser has reached the required minimum age. The delivery person will only hand over the goods after age verification has been completed and only to the buyer personally. In this case, delivery to parcel stations is not possible.
